ASNC Election Challenged

There was a considerable effort made to correct a typo on the Mt Washington ASNC 2007 Ballot (it didn't indicate a stakeholder should vote for TWO candidates) prior to the ASNC 2007 Election, held November 27, 2007. Here's a list of the activity surrounding the correction:

However, despite this, there has been a challenge to the election by Joe Riser.

An AGENDA item for the ASNC Board meeting held December 17, 2007, announced the following:

5. Discussion regarding the challenge to the 2007 election. DONE representative may be available to make an official report including any steps that the ASNC Board members need to take.

and this, from the Minutes, is the discussion that ensued:

5. Pat Griffith reads an email regarding an election challenge. If the challenge is not resolved, there is a possibility the new board will not be taking their seats in January. Eliot Sekuler offers to write the letter about the challenge to the board members. Ann Walnum is concerned that the wording was not such that people knew that they should choose two candidates in one of the districts. She takes the position that if she had a choice she would make a suggestion that a new election be held. Paula Sirola finds it awkward to suggest a celebration in January to welcome new board members and thanking old board members.

Ernie-

We need to have some notice go out to stakeholders and the candidates that there has been a challenge filed against this election. So far, we have heard nothing from DONE about assigning a FDM, which presumably is because Naheed is out for a while.

I do not know whether the challenge can affect all the electeds or just the Mt. Washington candidates, but some notice and discussion, and hopefully a report from DONE, needs to be made at the Monday meeting, so this needs to be on the agenda.

I am including Jon Martinez, the DONE Project Coordinator, on this, and hopefully he can tell us the next steps re: the election challenge filed 2 weeks ago.

This means it is 'possible' that the new board may not be sworn in and take office at our January meeting.

Who will contact the new Board members?

The Final Decision Maker for the election is the Human Relations Commission for the City of L.A. (HRC). HRC has acted as the FDM for all NC elections since the Citywide Election Procedures went into effect in early 2006. The HRC has 30 days to resolve your election challenge, however, they have the option of requesting two additional 15-day extensions (for a possible total of 60 days).

The Citywide Election Procedures, and the procedures for your election, do not allow for newly elected board members to be seated or take office until all challenges are resolved. The existing board members may remain in office so that your Neighborhood Council may continue to conduct regular business, pending the resolution of all challenges to your election.

The status of the Election is pending, as is the AGENDA, DATE and LOCATION of the next ASNC Board Meeting (normally it would be held in January, 2008, and include the installation of newly elected Board Members).
